12 numaralı Nevşehir şer'iyye sicili (H. 1324/m. 1906-h. 1331/m. 1913) (Transkripsiyon ve değerlendirilmesi)

Abstract

Şer'iyye sicilleri Osmanlı Devleti'nde merkezde ve taşrada her tabakadan insanlar arasındaki hukuki ilişkilere dair kayıtları içeren defterlerdir. Osmanlı hayatının aile, toplum, ekonomi ve hukuk tarihi gibi alanlar için önemli kaynaklardır. Çalışmamız Osmanlı tarihinin aydınlatılması bakımından önemli bir yere sahip olan (H.1324/M.1906-H.1331/M.1913) tarih aralığını kapsayan 12 numaralı Nevşehir Şer'iyye mahkemesi kayıtlarını içermektedir. 12 numaralı Nevşehir Şer'iyye Sicili defteri 52 yapraktan oluşmaktadır. Defterde bulunan belgeler 135 hüküm olarak numaralandırılmıştır. Ancak defterdeki belgeler numaralandırırken 33. Numaradan 35. Numaraya sehven atlanılmış olup, 34. Numara yazılmamıştır. Bundan dolayı defterdeki hüküm sayısı 134'tür. Defterdeki oranlar 134 hüküm üzerinde yapılmıştır. Defterde geçen hükümlerden 130 hükmü vekâletname hücceti, 2 hükmü ilam, 1 hüküm veraset tayini hücceti ve 1 hükmü de satış hüccetidir. Varis ve varis tespitine dair hükümler, iş ve iş devri ile ilgili hükümler, boşanma, nafaka ve mehr, kişisel davalar, menkul ve gayrı menkuller gibi konular bulunmakta olup Nevşehirde ki Osmanlı toplumunun sosyal ilişkilerini, ailevi ilişkilerini ve idari yapısını yansıtmaktadır.

Şeriyye records are books containing records of legal relations between people of all layers in the center and in the countryside of the Ottoman Empire and are important sources for the history of many areas of Ottoman life such as family, society, law and economy. Our study includes the court records, 12 number recorded in Nevşehir that covering the dates between (H.1324/M.1906-H.1331/M.1913) from şeriyye records which has an important place in the Ottoman history and culture. The Number 12 of Nevşehir Şer'iyye records has 52 iconsists of leaf. The documents contained in the book are numbered as 135 provisions. However, when numbering the documents in the book, number 35 from number 33 was mistakenly skipped. Number 34 is not written. Therefore, the number of provisions in the book is 134. The rates in the book were terms on 134 provisions. 130 provision of the provisions mentioned in the book is the power of attorney huccet, 2 provision I'lam, 1 provision determination of inheritance huccet and 1 provision sales huccet. Heir and heir provisions, business and business cycle provisions, divorce, alimony and mehr, personal litigation, there are securities and real estate securities topics. It reflects the social relations, family relations and administrative structure of Ottoman life in Nevşehir.
