İslam hukukunun amaçları ışığında nikâh sözleşmesinde kadınları koruma sistemi

Abstract

İslam hukuku, bir dizi yüce amaçlara (makâsıd) ulaşmak üzere, birbirine bağlı olan bütünleşmiş bir hükümler sistemidir. Aile hukuku, İslam hukukunun ana bölümlerinden biri olarak kabul edilir. Bu bölümün hükümleri, bireysel ve kamu menfaatlerini göz önünde bulundurarak,tarafların arasında bir denge durumu sağlamak için düzenlenir. İslam hukukunun, her zaman ve her yere uygun olması, en belirgin özelliği olarak kabul edilir. İslam hukukunun üstün özelliklerinden birisi, bölümlerinin ve hükümlerinin teşrî kılındığı genel amaçları gerçekleştirmesi ve hükümlerinin birbirleriyle uyum içerisinde İslam hukukunun kamusal, özel ve kısmî amaçlarını yerine getiren birbirine bağlı sistemler halinde olmasıdır. Bu araştırmada, İslam hukukuna göre nikâh sözleşmesinde kadının korunma sistemi ve kadını yasal, sosyal ve dini bakımlarından koruyan hükümlerin birbiriyle bağlantısı ortaya konulmaktadır. İlgili hükümleri değerlendirirken, bir dizi amaça ulaşmak üzere ve sisteminin oluşturulması için bağlantılı olan çalışma, eğitim, uygulama ve etkinleştirme alanlarının dikkate alınması gerektiği üzerinde durulmaktadır. Aynı şekilde nikâh sözleşmesindeki kadınları koruma altına alan hukukî hükümler sistemine temas edilmekte ve koruma altına alınan hukukî hükümler sistemi nikâh akdinde basamaksız olarak ele alındığından, kadınlara yönelik hukuki koruma sistemi yüce amaçlarının ve hedeflerinin tespit edilmesi açısından da ele alınmaktadır. Özetle bu araştırma nikâh sözleşmesinin önceki veya sonraki hükümleri, ilgili korumanın şekli ve amaçlarını ele almaktadır, Araştırma, uygulama ve yasalaştırmada İslam hukuku alanlarındaki araştırmacılara fayda sağlayan sonuçlara ulaşma çabası içindedir

Islamic law is an integrated system of rulings that are interconnected to achieve a set of sublime objectives, and family regulation is considered as one of the main chapters in Islamic jurisprudence, where the provisions of this section are organized to achieve a state of balance between the individual needs and the public interests, which is the most prominent feature of Islamic law that is suitable in every time and everywhere. One of the miracles of Islamic law is that its chapters and rulings achieve the general objectives that it was legislated for, and the rulings are combined with each other to form interconnected systems that fulfill the objectives of Islamic law in it’s public, private, and partial forms.in this research, the researcher reveals the protection system of women in the marriage contract according to the Islamic law, and he reveals the interconnection of the provisions that protect women in the marriage contract, as they form together a system that provides three forms of protections: legal, social, and religious. These provisions, as they are linked to form this system achieving a set of objectives that must be considered when considering this system for study, education, application and activation. From this standpoint, the research deals with the legal protection system for women in the marriage contract from the angle of identifying its lofty aims and objectives, as it deals with the system of legal rulings that shade women with protection in the marriage contract without the steps and provisions before or after it, and the research also deals with the forms and purposes of this protection, In an attempt to reach results that benefit researchers in the fields of Islamic law in research, application, and legalization.
