Havâss-ı Refîa (Eyüp) Şer'iyye Sicillerine göre Seyyidler1113-1126 (1702-1714)

Abstract

Bu çalışmada XVIII. yüzyılın ilk çeyreğinde Havâss-ı Refîa (Eyüp)'da yaşayan Seyyidlerin sosyal-toplumsal ve ekonomik hayattaki rolleri ele alınmıştır. Osmanlı Devleti'nin başkenti olan İstanbul'un en önemli kaza merkezlerinden biri olan Eyüp'teki seyyidlerin yaşam tarzlarına dair sosyal, toplumsal ve ekonomik alana bir katkı sağlamak amaçlanmıştır. Yine amacımız Eyüp'te 1702-1714 yıllarında mahkeme kayıtlarında yer alan seyyidlerin bahsedilen rollerine dair var olan boşluğu bir nebze de olsa doldurmaktır. İstanbul Müftülüğü Arşivi'nden temin ettiğimiz 16 adet Şer'iyye Sicilleri defterleri incelenmiş ve seyyidlerin yer aldığı davalar belirlenip konularına göre sınıflandırılarak bu çalışmamız şekillenmiştir. 1702-1714 yılları arasında Eyüp şer'iyye sicilleri kayıtlarına yansıyan aile, nafaka, tereke, mülk-arazi, hibe, cinayet, darp, kefalet, vekâlet, rehin, su yolu, hüccet, vb. gibi daha pek çok konuda seyyidlerin davalardaki rolleri ve o dönemdeki sosyal, toplumsal ve ekonomik hayattaki varlıklarına dair bilgiler kayıtlara yansıyan örneklerle verilmiştir. Bu tez çalışması Giriş ve 3 Bölümden oluşmaktadır. "Giriş" bölümünde mahkeme kayıtlarının tutulduğu Şer'iyye sicilleri, Eyüp kazası ve Eyüp Kadılığı hakkında bilgi verilmiştir. Birinci bölümde "Osmanlı'da Seyyidler ve Şerifler" başlığı altında, Seyyid, Şerif, Seyyidlerin Osmanlı toplumundaki rolleri ve Nakibü'l-Eşraflık Kurumu hakkında genel bir bilgi verilmiştir. İkinci bölümde "Sosyal ve Toplumsal Hayatta Eyüp'teki Seyyidler" başlığı altında, boşanma, nafaka, mihr, dini rolleri, tereke ve su keşif hücceti davaları gibi konular ele alınmıştır. Üçüncü bölümde "Eyüplü Seyyidler ve Ekonomik Hayattaki Rolleri" başlığı altında su yolu davaları, beytülmal adına el konulan mallar, rehin bırakma, mülk arazi davaları, alacak talepleri, kefalet senetleri, hibe vb. gibi konular başta olmak üzere birçok dava incelenmiştir.

This study the roles of Sayyids living in Havâss-ı Refîa (Eyüp) in the first quarter of the XVIII in century in social-social and economic life were discussed. It is aimed to make a contribution to the social, social and economic field regarding the life styles of the sayyids in Eyüp, one of the most important accident centers of Istanbul, the capital of the Ottoman Empire. Again, our aim is to fill the gap that exists regarding the mentioned roles of the sayyids in court records between 1702-1714 in Eyüp. The 16 Sharia Registers books we obtained from the Istanbul Mufti Archives were examined and the cases involving sayyids were determined and classified according to their subjects, and this work was shaped. Between the years 1702-1714, family, alimony, estate, property-land, donation, murder, assault, bail, power of attorney, pledge, waterway, solidarity, etc. The roles of sayyids in lawsuits and information about their existence in social, social and economic life in that period are given with examples reflected in the records. This thesis study consists of Introduction and 3 Chapters. In the "Introduction" section, information is given about the Şer'iyye registers where court records are kept, the town of Eyüp and the Kadilik of Eyüp. In the first chapter, under the title of "Sayyids and Sharifs in the Ottoman Empire", a general information was given about the roles of Sayyids, Sharifs, Sayyids in Ottoman society and the Nakibü'l-Eşraflık Foundation. In the second chapter, under the title of "Sayyids in Job in Social and Social Life", issues such as divorce, alimony, mihr, religious roles and estate are discussed.
