Mezhep, yetkin bir hukuk adamının nassları yorumlarken izlediği yöntem ve kuralların bütünüdür. Bu terim müçtehidin hem usûlü hem de bu usûl sonucunda ulaştığı hükümlerin tümüne verilen addır. Taassup kavramı ise, İslam siyaset edebiyatında özel bir yeri olan “asabiyet” kelimesinden türemiştir. Asabiyet; kolektif aksiyon gücünü ve kişilerin aidiyet duygusuyla mensup oldukları sosyal gruba yardım etme eğilimidir. Buna göre asabiyet soydaşlık ile kazanıldığı gibi insanları birbirine kaynaştıran her tür ilinti ile de teşekkül edebilir. İslami literatürde de “asabiyet” sadece kabilecilik
için kullanılmamış, her türlü fanatiklik bu kapsamda değerlendirilmiştir. İlk
asırlarda İslam âlimlerinin delillerden hüküm çıkarma konusunda gösterdikleri olağanüstü gayret mezheplerin ortaya çıkmasından bir süre sonra yerini taklide bırakmıştır. Belli bir müctehidi taklit etme ve mezhep bağlılığının hukuk güvenliği, adli istikrar ve hükümlere ulaşmada pratik kolaylıklar sağladığı bir gerçekse de bünyesinde “mezhep taassubu” gibi gizli bir tehlikeyi barındırdığı da inkâr edilemez. Nitekim hüküm çıkarma melekesinin kaybolması ve fıkhın tek mezhep üzerinden öğretilmeye başlanması çok geçmeden bağnazlık düzeyinde mezhep müntesiplerini ortaya çıkarmıştır.
Sözünü ettiğimiz bağnaz tutum elbette salt düşünce zemininde kalmamış,
tarafların kendilerine özgürlük alanı açarak karşıt mezhepleri baskılama
girişimlerini de bir şekilde motive etmiştir.
The Mazhab is a whole of methods and rules that a competent
lawman follows in interpreting the nass. This term is a name given to all of
provisions reached by the mujtahid as a result of this procedure. The term
taassub is derived from the word asabiyyawhich has a special place in Islamic political literature. Asabiyya is a tendency to help the social group to
which they belong with the collective action force and the sense of belonging. As such, asabiyya can be formed by any kind of correlation that fuses people together as it is acquired by consanguinity. In Islamic literature,
asabiyya was not only used for tribalism, but all kinds of fanaticism were
evaluated in this context. In first centuries, extraordinary efforts of Islamic scholars to make judgments out of adilla left its place to taqlīd after the
emergence of the sects. It cannot be denied that a certain mujtahid’s taqlīd
and sectarian loyalty provide practicality in terms of legal security, judicial
stability, and access to provisions it is also undeniable that it has a hidden
danger such as sectarian taassub (bigotry). As a matter of fact, the loss of
the ability to take action and teaching of jurisprudence through a single
sect soon produced sectarian counterparts at the level of bigotry. Ssectarian bigotry we mentioned did not remain on the ground of mere thought,
but somehow motivated the attempts of the parties to open up an area of
freedom for themselves and suppress the opposing sects. In this context,
use of political influence of the statesmen in favor of the sect they belong
to, the words of some of the authors that do not fit in the honor of knowledge about each other, burning of books containing other sectarian views,
to over-praise a sect and its founder and to make-up hadiths for this cause,
physical fights, torture and exile of some scientists (mihan), separation of
masjids and madrasas based on sectarian differences and some other negative manifestations of the sectarian taassub seen in history.
