Terörizmi özneleri üzerinden anlamak: terörle mücadele kanunu için bir tanım önerisi

Abstract

Terör eylemleri gerçekleştirecek olanların caydırılabilmesi de bu eylemleri gerçekleştirenlerin cezalandırılabilmesi de terörizmle etkili mücadele için gereklidir. Ancak bunun için terörizmin fail ya da azmettirici niteliğini haiz çeşitli özneleri olabileceğini öngören bir terörizm tanımına ihtiyaç vardır. 3713 sayılı Terörle Mücadele Kanunu “örgüt” kavramını terör eylemlerinin mutlak bir şartı olarak kabul etmektedir. Oysa terörizm (terör eylemleri) örgütlerden başka kişiler, devlet dışı silahsız aktörler ve devletler tarafından da gerçekleştirilebilir. Bu aktörlerin her biri siyasî şiddetin bir türü olan terörizmi menfaatleri gereğince araç olarak kullanabilirler. Şiddetin ya faili ya da azmettiricisi olarak siyasî amaçlarına ulaşmaya çalışabilirler. Çalışma bu aktörlerin terörizmin özneleri olmalarının gerçekliğini inceleyerek 3713 sayılı Kanun için bir terörizm tanımı önermektedir. Böyle bir tanım Türkiye Cumhuriyeti Devleti’nin terörizmle mücadelesine hem ön alıcı hukukî tedbirler çerçevesinde katkılar sunabilir hem de terör suçları işleyen tüm öznelere yaptırım uygulanabilmesini yasal olarak tartışmasız hale getirebilir.

Both deterring those who will commit terrorist acts and punishing those who commit these acts are necessary for an effective fight against terrorism. However, there is a need for a definition of terrorism that foresees that terrorism can have various subjects as perpetrator or the instigator for this. The Fight Against Terrorism Law No. 3713 accepts the concept of “organization” as an absolute condition for terrorist acts. However, terrorism (terrorist acts) can also be carried out other than organizations by individuals, non-state unarmed actors and states. Each of these actors can use terrorism, which is a type of political violence, as a tool for their own benefit. They may try to achieve their political goals by being either the perpetrator or the instigator of violence. The study proposes a definition of terrorism for Law No. 3713 by examining the reality of these actors being the subjects of terrorism. Such a definition can both contribute to the State of the Republic of Türkiye's fight against terrorism within the framework of preemptive legal measures and make it legally undisputed that sanctions can be imposed on all subjects who commit terrorist crimes.
