İslami ilimlerde birleştirici yorum: Tenevvü ihtilafı

Abstract

The term of difference is means to accept one of the different ideas. Although it evakes of negative meanings, as regards to juridical cases, it is regarded as a positive fact on behalf of the theari es that lead to differences. On the other hand, all technical differences carınot be regarded as the same because they have argumentations that overrole each other. This article explains that some differences are not in opposition to one another, but they create a diversity. This is undertaken from the difference which has two kinds; diversity and oppositeness. According to this, the field of difference of diversity is as follows: the different applications of islaınic schools that depend on authentic tradition, the literal argumentations that scholars of the islaınic law methodology mak:e between them, the exegesis differences that has same meaning and the reading points that appear at the reading of Qur'an. At the points mentioned above, although all supporters of a point may accept that they are right and trutlıful, they cannot reject the righteousness or trutlıfulness of others.

"Farklı görüşlerden birisini benimseme" manası ~ıyan ihtilaf terimi, ilk duyulduğunda olumsuz anlamlar çağnştırsa da, içtihat söz konusu olduğunda, bu ihtilaflara kaynaklık eden teoriler adına olumlu sayılabilecek bir olgudur. Diğer taraftan bilimsel ihtilafların hepsini, birbirini nakzeden tartışmalar olduğu yargısıyla aynı kefeye koymaroiık gerekir. Bu makale, ihtilafın "Tenevvü" ve "Tezat" şeklinde yapılan ikili tasnif'inden yola çıkarak, bir kısım görüş ayrılıklarının zıtlık/çelişki olmayıp, çeşitlilik kabilinden varsayıldığını ortaya koymaktadır. Buna göre Tenevvü İhtilafının alanlarını şöyle sıralayabiliriz: Mezheplerin sahih sünnete dayanan farklı uygulamaları, fıkıh usulcülerinin kendi aralarında yaptıkları lafzi (sözde) münakaşalar, aynı anlama gelen tefsir farklılıkları ve Kur'an-ı Kerim'in tilavetinde ortaya çıkan kıraat vecilıleri. Bu sayğığımız hususlarda bütün taraflar kendisini hak/musib kabul etmekle birlikte başkalarını ret ve inkar yoluna gidemezler
